Perhaps most important, ask customers to list at least three trade references you can call to ask about payment practices. For example, when contacting references, you could ask: Does the customer consistently pay the full amount due on time, or do they occasionally (or frequently) fall behind on payments? If so, are there legitimate reasons, and is the customer proactive in communicating openly and working toward a payment solution?

After checking trade references, the next step is to run a formal credit check on the customer. You can use your local credit bureau or one of the following financial-rating services.

Dun & Bradstreet’s Paydex numerical scoring system uses a multitiered approach to rate a business’s credit. A Paydex score of 80 indicates that a business pays its bills on time. This is usually the minimum score you’ll want to see before you grant credit. A score of 70 or below indicates consistently late payments, ranging from 15 days late to 120 days or longer. Equifax’s Credit Information Score is based on a wide range of payment data, including how long a company has been in the Equifax database, its current payment index, the number of payment references or inquiries on the company in the past 90 days, and the number of and most recent negative items. For instance, we may make excuses for not committing the necessary time to developing business. We tell ourselves we are just too busy. Frankly, I know very few people who relish this. But sometimes you have to just suck it up and remember that everything you want is just outside your comfort zone. Make the effort to meet new people and you will almost always be rewarded. 

Then there are some of us lawyers who can be overly critical (shocking, I know)… critical of others or even of ourselves or our own abilities. Rather than being open to new things, we reject them out of hand to avoid mistakes or embarrassment. But to be successful at business development, you can't be afraid to try new things and make a few mistakes. In the long run, they will make you a better business developer - and a better person.

Others of us may be perfectionists. While this can be a beneficial trait for practicing law, this tendency can actually get you in trouble in business development. I have seen so many business development plans that are beautifully prepared, bound in fancy notebooks… and gathering dust on the shelf. The goal of business development is not to wait to make a move until you are fully prepared for every contingency – which is impossible anyway. You would be much better served to focus on the execution. Do something. At a minimum, do more than you are doing now. If you don't fight you can't win.

What is 'Normal'?

While changing clothes at my gym some years back, I frequently ran into a guy I'll call Tim. After Tim found out that I made my living as a psychotherapist, he invariably greeted me like this: " Hey, Jimmy!! How are you? and how are the crazies, today?"

Typically, I just played it off somehow, but eventually got so annoyed with it whenever I happened to run into Tim that one day I said, "Tim, you know, my practice isn't really about 'crazies'...those folks have a tendency to be seen in psychiatrists' offices."

"Oh..." he said. "But I thought..."

"No," I interrupted, "most people going to psychotherapists are not 'crazy'...the ones who really need psychotherapy have a tendency to stay away."

"Really?" he said, looking a little nervous now.

"Yeah, really. Most of the people I see are 'normal'...people just like you and me."

And with that, I pretty much killed the 'how're the crazies?' gambit. But it makes me think about what we mean when we say that someone is 'normal'?

It seems that 'normal' has become another way of saying 'healthy', and that either word can be used to describe a state of being in which a person appears to contain no internal conflict, no challenging mood, is not disturbing associates or family and friends, does not question himself about anything, and is not particularly dependent on others. 'Normal' seems to mean that a person is not driven by compulsions or desires they can't control, that he is perfectly 'in control' of himself at all times.

A typical question in therapy is the the one that begins, "Is it normal to...(fill in the blank with whatever it is about yourself that puzzles you)". Which means that if the therapist can be gotten to pronounce a thought, action or desire 'normal', then all is well. I could probably go on quite a bit more about the popular conception of 'normal', but I think I've made my point. Perhaps we could just boil 'normal' down to 'appears to need no help' or something like that...whatever.

I happen to believe that 'normal' is the pathology I deal with in my psychotherapy practice. Anybody who has read Shakespeare will know that humanity is full of odd desires, uncontrollable compulsions, delusion, willful dishonesty, aggression, hatred, sorrow, remorse, etc.

'Normal' also includes those who have witnessed acts of violence, been recipients of same, or were raised by those who committed acts of violence against themselves either in sudden, catastrophic acts, or by lighting one cigarette after another for years on end. Or, who drank one whiskey after another....

'Normal' also includes those married people who love one another, but cannot quite figure out how to live together happily. 'Normal' is to experience crippling self-doubt, paralyzing fear, profound self loathing, or unhappiness with life itself.

It is normal for teens to be moody and self-involved, to show little empathy for others, to be fascinated with 'darkness', to fear commitment. It is normal for children to have trouble structuring their time and taking responsibility for their actions.

Does all this mean that people should not seek help when it all becomes too much? Not at all- what is wish to say is that it is 'normal' to suffer, and to seek assistance with that suffering.

California Law Prohibits Credit Checks for Certain Employees

Earlier this week, California Gov. Jerry Brown signed a bill that would prohibit employers to request credit reports from job candidates for certain positions. The bill, AB22, which will be effective as of January 1, 2012, restricts the use of consumer credit reports in the hiring process to individuals who will work in law enforcement, a financial institution or the California Justice Department, among others.



If you do not currently do business in the state of California, the news is still pertinent to the rest of the country, as California is the seventh state to enact such a law, and at least 20 other states have considered similar action. A Congressional bill that would limit the use of consumer credit reports for employment purposes is also under consideration, but the House has yet to approve it.


For states that do not have a law to limit address to consumer credit reports, employers are allowed to obtain credit reports for both current and prospective employees. The employer simply must request permission from the employee or future employee, and notify the person if he or she was not promoted or hired because of negative findings.
